Policies -- Store Buyer
How can I view your Spring 2009 collection in-person at market?
If you are a store owner, we welcome you to view our latest collection at market. Please click the link,
below, to see our upcoming market tour schedule. By each show, you will see contact information for calling and making
an appointment. Our reps service many store accounts at each show, so it is highly advisable to please call
ahead and make an appointment.
Will you accept a Spring 2009 preorder directly from a store owner?
If you are a store owner, we recommend that you place your order with our sales rep in your part of the country.
We have reps in every territory inside the United States as well as Canada so please find out who your
rep is by clicking the link below:
We will accept an order direct from you, if: 1) you live in a country where
we do not have a rep 2) you are unable to attend any of our market shows 3) you are placing an order thru our Store
Referral Program, where someone recommended our line to you (if so, please provide their name
at the time of placing)
All Spring 2009 preorders placed with us directly will require a 50% deposit
at the time of placing and the balance due at shipment or else prepayment in full with a 10% prepay discount.

available? Yes, we still have some summer 08 overage which you may order from. Simply click on the
link below to see what we have left. The pricing shown on our website is retail. You
will receive 50% off of what is shown, plus additional volume discounts, since this is now considered end-of-season merchandise.
Sizes are selling out quickly so we encourage you to order sooner rather than later. Please contact us directly to purchase
this merchandise. We hope to liquidate all remaining stock by the end of August 2008. Shop Online -- Summer What happens if I receive merchandise from you and I need a different size? Please contact
us to see if we can make an exchange for a different size, based on our current inventory. We are always happy to try
to accommodate. I am a store owner and am wondering how I can be an exclusive carrier of your brand?
We do offer brand exclusivity in writing to store owners who commit to purchasing a minimum of $7500 per season.
This committment means that we will not sell to a competitor of yours within a 30-mile radius. All territories are negotiated
before agreed to.
What if I am a store owner who wishes to cancel my order placed
at market? You have TWO WEEKS from the time you write your order to cancel. This policy is stated
at the bottom of our order forms. After that time, stores are contractually liable for their entire order.
Since we are placing this order on your behalf thru our factory and having goods cut and sewn specifically for your store,
we encourage you to strongly consider this before placing with us. Please know we do enforce a very strict adherence
policy to all orders placed with us thru legal means, as we do not take breach of contract issues lightly.
We additionally require a 25% non-negotiable restocking fee.
As a store owner, what are my payment options? Credit card
ONLY. We accept MasterCard, Visa, American Express, as well as payments thru Paypal. We will no longer
ship any orders via COD based on a few bad apples ruining it for the whole bunch, sorry folks.
Do you provide net-30 terms to stores? No, not anymore. We
have gone to a credit card only policy.
I am a store owner and was asked to put a 50% deposit down on my preorder.
Why? If your preorder was over $5,000 or you placed your order with our company directly
and not thru a rep, you will be asked for a deposit for security precautions. What happens if I am a store owner and have had my buying privileges
taken away? It means you will not be able to purchase our brand again until your store is returned to good
standing. To have received a blacklist status, it means that a number of things might have happened: 1) you
did not pay your invoice within 45 days. 2) we shipped your production order via COD and you refused to accept it. 3) we shipped your production order via COD and you provided us a bounced check. 4) you cancelled your
preorder two weeks after placing it, right up until the time of shipment. 5) you could be any store we just
deemed as a problem customer or an owner who was very rude or extremely difficult to work with. 6) you could have been
discovered to be selling current season merchandise on an auction site.
I am a store owner whose buying privileges have been suspended and I
wish to have my store return to good standing. What do I need to do? 1) you need to go thru the
steps as any new store would and have an understanding of our policies. 2) as the store owner, you
must fax to us a signed letter stating why we should reconsider your blacklist status. 3) you must pay for your order
via credit card ONLY.
What is your policy concerning retailers who sell your product via auction
sites during prime selling season? Effective 8/1/07, if a store is discovered to be selling current
season goods on any auction site, they will be given a blacklist status. This means that the store's buying privileges
will be indefinitely suspended unless certain restrictions are met. This policy will be strictly enforced and our
reps will be kept informed of any stores in their territory who have violated our selling policies. Please know
this policy is put in place to protect our retailers from the devalueation of our merchandise. We want them to be able to
sell our goods for full retail value and not have to worry about competing with any auction site during their prime selling
season.
What is your policy about putting merchandise I buy from you on ebay
or any other auction site? As a manufacturer, this subject is like an elephant in the room that no one wants
to talk about, however, we think if there is an elephant in the room, we should properly introduce it. Current season merchandise on ebay or any other auction site is posing a problem for
manufacturers and the retailers who carry their brand. The motto is, "why pay full price for something when
you can find it on an auction site?" Right? Well, we would like the retailers who carry our brand to
be able to sell each collection of ours for full retail without having to compete with online auction sites. As a result, we have pretty strict policies concerning
this. Let's be clear in one thing, we do not have any problem with last season's merchandise or prior
seasons merchandise appearing on any auction site, it just cannot be current season merchandise. Right now, our
current season merchandise is fall/winter 2008. We do not want to see that collection appearing on any auction
site prior to January 2009, when it becomes end of season goods. For the buyers who disrespectfully violate this
policy, we will suspend their buying privileges with us. We appreciate your understanding.
So, when can merchandise appear on auction sites? At the end of season,
ONLY. For example, as we approach the end of summer 08 (July/August), then that is when our spring/summer
08 collection is permitted on an auction site. Not sure about it? When in doubt, please always ask.
